Title
The name of the Union Shall be Haryana State Electricity Board Workers Union in abbreviated terms “H.S.E.B.W.U.”
Definitions
“Union” Haryana State Electricity Board Workers Union.
“Board” the employer i.e. Haryana State Electricity Board.
“Workers” Any Person Employed by the Board other than officers shall be termed as worker, whether he is skilled or unskilled, regular or work-charged, Part Time or casual. Technical or non-technical, allocated to Bhakhra Management Board, U.T. Chandigarh and in the Beas project Board.
Ammended Clause: Any person employed by the Board other then officers shall be termed as worker whether he is skilled or un-skilled, regular or work-charged, technical or non-technical allocated to BMB/UT Chandigarh and in the Beas project Board.
Ammended clause: The word” Daily wages” now shall be added in the definition of the workman. Any person employed by the Board other than officer shall be termed as workman whether skilled or unskilled, regular or work charged, technical or non technical, daily wages and allocated to BCB, BMB & UT Chandigarh
Office
The Union shall have its own accommodation for office at some central place in Haryana which shall be decided by the Central Council of Workers Union. Till that time interim arrangement shall be made at Hisar. The change of office can be made by the Central Council of the Union till its’ permanent arrangements are made by giving one month’s notice of such change to all concerned
Flag
The flag of the union shall be white with symbol of pen in a plier in a circle within flag
Aims and Objects
To organic and enroll all workers of the “Board” whether they are in B.M.B., U.T. Chandigarh & Beas Project.
To safeguard and fight for the rights and privileges of workers of the union and their interests.
To Foster the spirits of solidarity, service, comradeship and co-operation amongst the workers. To develop the sense of discipline and sincerity.
To promote harmonious relation between workers themselves and to secure for them by all legitimate means. To provide aid during disputes, legal proceedings, sickness and un-employment etc. arised while in service, Union will help every regular member in case of dispute and person calamity provided the abide by rule and regulation of the union.
To develop and create institution of mental up life and enlightenment for workers i.e. study, circles, club, Publication of articles and periodicals etc.
To educate workers for their rights and duties. To per sure the govt. for enactment of bye laws and enforcement of the laws for safeguard of the interest & welfare of the workers.
To grant Honorarium to deserving active union workers for the harm caused due to participation in union activities.
To enthusiast the spirit of self help through co-operative societies organization to meet with the unforeseen happenings.
To raise special funds from workers as well as from outsider for interest of Union.
To Endeavour for furthering the above objects of the union through legitimate, democrate and peaceful methods.
To federate and reaffilate with any other unions existing or would exists at any part of India and may join hands with union/ Organizations/Associations of similar aims and objects.
To Strive for workers representation in management for the commercial policy of the Board with an idea to make it more profitable and equitable for the mutual of both i.e. “workers and Board”
To do any such other things as considered necessary, Incidental or conductive to the attainment of the above aims and objects within the scope of Indian trade union act, 1926.
“Financial year”
The financial year of the union shall be from 1st day of January to last day of December each year.
Ammended clause: The financial year of the union shall be from 1st April to 31st March each year.
Member-Ship
Every employee of the board who is a workman under the (ID) Act. shall be entitled to admission as an ordinary member of the union provided that Central Council here-in-after defined shall have powers of refusing admission to any person for reasons considered sufficient by the said body.
Any person other worker under article 7 (a) above agrees with aims and objects of the Union can be enrolled as member with the Central Council or may be co-opted/appointed as Honorary and Temporary office bearer of the Union.
Ammended Clause: No outside can be the member of the Union.

C: - An employee who is not member of the union and wants to seek the membership on account of his transfer or otherwise to get union shelter may be allowed membership at new station of posing.
Admission
Admission as a member of the Union shall be allowed after signing the prescribed form, pledge and on payment of admission fee of Rs. One. The membership form shall be kept in the office of general secretary.
Membership Register
The membership register shall be maintained by the Union at its registered office which will bear full address of each worker. Each Circle, Unit shall maintain its register and will send a list of Circle Workers for record in the central office of the Union. Every regular member can inspect the membership register in office hours.
Donation and Contribution
Union may collect donation and special contribution from workers and outsiders to raise funds under the seal of Financial Secretary and though authorized workers.
Utilization of Funds
The funds of the workers Union shall be utilized on the following items:-
Office stationary, Postage and typing.
Printing of various forms, circulars, posters and letter heads etc.
Actual journeys and other expenses of office bearers and workers.
To arrange conference/meetings with other Unions/Associations.
Accounts
The Accounts of the union shall be maintained by the office secretary under the directions of Financial Secretary. The office secretary shall be full time worker to the union.

The funds shall be maintained through a schedule bank in the name of the union, operatiable by any two of the following :
“President, General Secretary and Financial Secretary”.
The different units shall deposit full collection to the Financial Secretary and shall take advance for its day to day expenses from central office of the union.
The accounts shall be kept open for all and accessible by all the Central Council’s office bearers and unit office bearers on 15 days notice to Financial Secretary.
The report of receipt and expenditure shall be circulated to units generally. Financial Report shall be circulated in General Delegates Conference and shall be read over in the house by the Financial Secretary.
The Unit may take Advance with in Rs. 100/- at one time from Financial Secretary for local expenses with the approval of President and General Secretary.

Ammended clause: Half the amount of annual subscription shall be deposited with the Central Council and rest of the balance money shall be kept by the units and sub-units. Extent of the units and sub-units share shall be defined by the Central Council. The expenditure over and above the limit shall not be made without express approval of the Central Council.
“Audit”
The Accounts of the union shall be audited by the Auditor quarterly appointed by Central Council and by the Chartered Accountant annually.
“Organizational Set up of the Union “
The affairs of the union shall be conducted through sub-unit, unit and circle committee and Central Council, thus elected co-opted or appointed under the constitution as here-in after stated.
Sub-Unit
The affairs of the workers in the sub-division comprising of other falls within its jurisdiction at different stations shall be conducted through Sub-Unit committee head-quartered at the station of the Operation Sub-Division. The Sub-Unit Committee shall consist the following office bearers.
President ii) Secretary iii) Cash Controller iv) Organizor and at least three committee members.
Ammended clause: the affairs of the worker’s Union shall be conducted by sub-unit committee. Each office of the board shall constitute a sub-unit committee unless & otherwise expressed by the unit. It shall consist following office bearers:-
President 2. Vice President 3. Secretary 4. Assistant Secretary 5. Cash collector 6. Organizor
The election of the committee shall be conducted by all the workers of sub units in the presence of minimum 50% members of the union by simple majority votes.
The sub unit committee should have representation from each office.
Ammended clause: The Clause-C stand deleted and existing clause-D shall be read as clause-C.
Interim vacancies caused by death, resignation, removal etc. shall be filled up by sub-unit committee amongst sub-unit members.
Unit
The Affairs of the members workers under Operation Divisions and offices located under its jurisdiction shall be conducted by unit committee consisting of the following office bearers.
President (ii) Vice President (iii) Secretary (iv) Unit Organizor (v) Jt. Secretary (vi) Cashier
(vii) Executive members at least-3.
Ammended clause: Generally each Operation Division and the area falls in its jurisdiction shall constitute an unit. This Formula of an unit shall not apply where there are more than one Operation Division, Thermal faridabad, Panipat and Surajpur Workshop Dhulkote, Headquarter offices at Chandigarh, B.C.B., B.M.B. and U.T. Chandigarh. The Central Council may form units according to its administrative convenience. The Office bearers of the unit committee will be elected by the sub unit delegates elected by the sub-unit members after ten and part thereof. The Unit shall consist the following office bearers:-
President 2. Vice President 3. Secretary 4. Assistant Secretary 5. Cash Collector 6. Organizor 7. Auditor 8. Each sub unit president as executive member
Ammended clause: a) One post of Senior Vice-President in each unit approved by the delegates conference.
b) Two unit Organizor is in each unit and four unit Organizors in each unit where more than four sub-units exist.
Ammended Clause: Each President & Secretary of the Sub-Unit will be the Executive members of the Unit.
The office bearers of Unit committee shall be elected by the delegates representing the Sub Units for the purpose. One delegate shall represent ten workers of part thereof to a Sub-Unit. The delegates shall elect Unit committee amongst the members /workers of the Unit whether he is an elected delegate or not.
Ammended Clause : All the Sub-Unit office bearers shall be the delegates for unit election.
Ammended Clause: The new Sub-Units and Units shall be auto generated as per bifurcation/creation of new Sub Division or Division in operation wing.
The Units of Thermal and Hydle shall be elected as per pattern of operation as approved by 19th Delegate Conference.
The interim vacancies caused due to resignation, removal, dismissal and death etc. shall be filled up by the Unit committee.
“Circle Committee”
The head-quarter of an operation Circle shall comprise a Circle Committee which shall include all the units in the jurisdiction of Operation Circle. The Circle Committee shall be headed by Circle Secretary comprising of Unit Presidents and Secretaries as its members. The Unit Presidents and Secretaries shall be ex- officiao members. The Circle Secretary shall be elected by the delegates of the particular circle in the delegates’ conference. The Circle Secretary shall be the member of the Central Council.
Ammended Clause: The entire workshop under Dhulkote shall elect the Circle
Secy. Of workshop Dhulkote.
Ammended Clause: The Circle Secretary shall be elected by the delegates/members/office bearers of (all the bearers of Units and Sub-Unit President and Secretary) the particular Circle wing at their Circle instead of Delegates Conference after the election of Units falls in its jurisdiction.
The Circle Secretary shall be the delegate to elect the Central Council as approved by 19th Delegates Conference.
Circle Committee shall manage the affairs of Circle. It shall meet once a month or in two months.
“General House of Delegates Conference”
The General House of Delegates conference shall be the assemblage of delegates from the different units of members/ workers of the union to elect the office bearers of Central Council. One delegate shall represent to 50 workers. Or part thereof to the unit. The General House of Delegates shall be Supreme Power of Workers Union. The conference of the General House delegates shall be called for by General Secretary once a year to elect Central Council of the union. The attendance of the least 50% delegates shall be essential to get the election conducted for the Central Council of the Union.
Ammended Clause: The General House of Delegates conference shall be the assemblage of delegates from the different units of member workers of the union to elect office bearers of Central Council. The delegates for the election shall be elected by the Sub-Unit delegates on the total strength of a unit. However representation be given to each Sub-Unit which consist at least 30 member. The Delegates so elected cease to act as delegates of the Elections of Central Council. One Delegate shall represent to 50 workers or part thereof to the unit. The General House of delegates shall be supreme power of the worker’s union. The conference of the General House delegates shall be called by the General Secretary of the union. The attendance of at least 50% delegates shall be essential to get the election conducted for Central Council of the Union.
Ammended clause: All the office bearer of the units shall be the delegates for Central Council Election
(b) The Special meeting of the General House of Delegates can be summoned on the requisition of ¼ delegates in writing to General Secretary to consider over the agenda of the meeting.

(c) The conference shall be empowered to consider over the report of Accounts submitted by Finical Secretary and constitutional amendments etc. of the workers union. The general meeting will be held in the month of January of every year for the purpose of election.
Ammended clause: The conference shall be empowered to consider over the report of Accounts submitted by the Financial Secretary and constitutional amendments etc. of the worker’s union. The general meeting will be held in the month of March or April every year for the purpose of election.

The general meeting of delegate’s conference shall be held in the month of April or may after two years for the purpose of election.
Ammended clause: The Delegate’s Conference shall be held in the month of September or October instead of April or may after two years for the purpose of election as approved by 19th Delegate Conference.
V “Central Council”
(a) The affairs at the state level shall be managed by Central Council elected by the general House of delegates under article 14 (iv) by simple majority of votes with following office bearers.
(i) President (ii) Vice President (iii) General Secretary-I (iv) Joint Secretary (v) Chief Organizor-I (vi) Circle Secretary-7 (vii) Financial Secretary –I (viii) Legal Adviser (ix) Auditor-I.
Ammended clause: The Affairs at the State Level Shall be managed by Central Council elected by the General House of delegates under Article-14 (iv) by simple majority votes with following office bearers.
(i) President (ii) Senior Vice-President (iii) Vice-President (iv) General Secretary (v) Joint Secretary-1 (vi) Chief Organizor(vii) Circle secretaries -11 i.e. One each for workshop Dhulkote, Thermal Faridabad, Panipat, B.C.B. & B.M.B. Ammended Clause : The delegates belongs to transmission /HVPN and workshop shall participate to elect the Zonal Organizor instead of Project Organizor and the area/zone for Zonal Organizor –1st shall be the area of operation circle Ambala ,Yamuna Nagar,Kurukshetra, Kaithal, Karnal and wokshop Dhulkot.
for Zonal Organizor –2nd shall be the area of operation circle Jind, Panipat,Sonipat,Jhajjar and Rohtak.
for Zonal Organizor –3rd shall be the area of operation circle Sirsa, Hisar, Bhiwani.
for Zonal Organizor –4th shall be the area of operation circle Fridabad, Gurgaon and Narnaul .
for Project Organizor shall be the area of Hydal, Thermal Yamunanagar, Thermal Panipat and Thermal Khaider(Hisar) as approved by 19th Delegate Conference.
(b) Interim vacancies caused due to resignation, death, removal or otherwise shall be filled up by Central Council through co-options.
15. Advisory Council
a) The members of good talent and caliber amongst different cadres of the workers shall be co-opted by the Central Council. The maximum limit of its members shall be seven and minimum up to three members. The member of Advisory Council shall elect Chairman to preside over its meeting. The chairman shall have right to attend the Central Council’s meeting but shall have no right to vote.
b) The Advisory Council shall prepare demand draft, grades and other valuable suggestion for the welfare of the union. After full discussion by the Central Council these advices shall be adopted by the workers union for negotiation with the board or other body. The advice of the Advisory Council shall not be binding.
c) The members of the Advisory Council can be removed from office on unsatisfactory working by the President and General Secretary of the Central Council with approval of the Council.
15 (a) Central Executive : (Ammended Clause) : The Central Executive consist of all office bearers of Central Council plus Units Presidents & Secretaries as approved by Delegates Conference.
16 “Meetings”
a) The Sub-Unit,Unit and Circle Committees shall meet after one and two months respectively. The Central Council shall meet ordinarily in three months except in emergency.
Ammended clause : The Central Executive should meet quarterly. Central Council bimonthly, Circle Committee, Unit Committee and Sub-Unit Committees monthly except in emergency.
B) Emergency and special meetings
The General Secretary shall convene the meetings of the Central Councils, transact the business an urgent nature in consultation with President.
C) Requisitioned meeting
It a signed requisition from 1/4 members of the total strength of General House of Delegates/Central Council/Unit/Sub-Unit Committee is received with General Secretary/Secretary as the case may be, then the meeting of any of the above bodies shall be called within a fortnight, failing which the requisitionists may take step to convene the meeting . The meeting so convened by the requisiteness shall be valid and legal. The decision thus taken by such requisionists body on the agenda shall be 2/3 majority members who attended such meeting and minimum quorum shall be at least 50% members of such bodies.
17. Notices
A week’s notice shall be given to summon the meeting of Central Council/Circle Committee/Unit Committee/Sub-Unit Committee in case of ordinary meetings and 24 hours notice shall be given for summoning the meeting of General House Delegates Conference. The notice for Units and Sub-Units and Circle Committee meetings shall be adopted as of Central Council.
Ammended clause: A week’s notice shall be given to summon the meeting of Central Council/Circles Committee/Unit Committee/Sub-Unit Committee in case of ordinary meetings and 24 hours notice in case of special urgent meetings. One month notice shall be given for summoning the meeting of General House Delegates Conference. The notice for Units, Sub-Units and Circle Committee meetings shall be adopted as of Central Council.
18. Quorum:
The quorum of the meeting for General House of Delegates Conference shall be 50% elected delegates and 2/3 in case of Central Council, Circle Committee, Unit Committee and Sub-Unit Committee.
Ammended Clause : The quorum of the meeting for General House of Delegates Conference shall be 50 % elected delegates and 2/3 in case of Central Council/ Central Executive/Circle Committee/ Unit Committee and Sub-Unit Committees.
19. Vote of Non confidence
a) If the activities of any office bearer or a member of the Union is doubtful then the vote of Non-Confidence can be moved against the office bearer/member. Such office bearer/members be expelled from the workers union by 2/3 majority votes by the Central Council. In case of the office bearers of Circle Committee/Unit/Sub-Unit, the recommendation of particular Unit/Sub-Unit shall be essential.
Ammended Clause :a) The Non confidence of Circle Secy. shall be made by 2/3 majority of all the member of Unit body in the Circle.
b). The Non confidence of unit office bearer shall be made by 2/3 majority of all Unit body member and Sub-Unit body members.
b) The vote of non confidence can be moved against President, General Secretary by the ¼ the Central Council. If approved by 2/3 majority of Central Council then the particular office bearer shall be deemed to have been removed from the date approval of the motion. The Central Council be empowered to co-opt another as office bearer by simple majority votes. The appeal shall lie to Central Council General House of Delegates.
20. Fines and Expulsion
Disregards of Unions Rules and Regulations shall be liable for fine, expulsion and other disciplinary action. Such delinquent member may appeal to the Central Council through General Secretary of the Union and if found reasonable then the Central Council may undone all parts of the fine and expulsion or disciplinary action.
21. Defaulting Workers/Circle Committees/Units and Sub-Units
a) Any worker/Sub-Units or Circle Committees works against the interest of the Union or fails to abide by its Rules and Regulations, can be expelled or suspended by the Central Council under normal circumstances and by the Action Committee in case of agitation period.
b) Any member/Sub-Unit/Unit or Circle Committee fails to pay monthly subscription consequently for four months shall lose his/its right of vote and will be deprived off all privileges and benefits of the workers union.
Ammended clause : Any member/Sub-Unit/Unit or Circle Committee fails to pay annual subscription shall lose his/it’s right of vote and will be deprived off all privileges and benefits for workers union.
Any office bearer fails regularly to attend meetings of the Central Council, Circle Committee, Unit Committee or Sub-Unit Committee shall lose to be office bearer of that body and respective body shall have right to co-opt other bearer in his place in the second default.
Any Sub-Unit/Unit/Circle Committee works against the Interest of the Union or not working activity for workers shall be dissolved by the President and General Secretary during peace time and by Action Committee at the time agitation. In its place adhoc committee shall be formed by the President and General Secretary. The election shall be conducted of such Unit/Sub-Unit/Circle Committee within 3 months.
If any office bearer defaults to give accounts and cash of the Workers Union to Central Council then the said office bearer shall be taken to the Civil Court under misappropriation and criminal breach of trust with the approval of the Central Council by the General Secretary of the Union. No un-authorized member shall have right to collect contribution on Union‘s receipts.
22. To take central Office Bearers on Foreign Service
Central Council shall be competent to seek 24 hour services of General Secretary or any other office bearer for workers union from the Board on payment of full emoluments of their salaries for their tenure from union funds.
23. “Strike”
When all peaceful means of negotiations become furtile for settlement of the demands of the Union under Article 5 of the Constitution, It may give a call for General Strike with following procedures.
To decide the vital issue of strike the meeting of Central Council plus Unit Presidents and Secretaries shall be called for. The 3/4th members present of the above shall be competent to decide for strike subject to ratification from 2/3 members of the Union upto Sub-Unit level in the manner decide by the majority members of the Union then a notice for strike shall be given by the General Secretary of the Union to the “Board” .The Action Committee may be formed for agitational approach to make call more effective. The joint declaration of President and General Secretary shall only be legal and binding for the Union.
Token Strike, Work to Rule or Processions and Agitations etc. can be decided by the Central Council of the Union by 2/3 majority votes. A notice of such intentions shall be given to the employer as well to the Govt.
24. Power to Frame Bye-Laws and Subsidiary Rules.
The Central Council of workers union shall be competent to frame bye-laws and subsidiary rules in the interest and for the benefits of the workers union subject to constitutional limits. The bye-laws and subsidiary rules should not contradict the articles of constitution.
25. Power and duties of Office Bearers
The Central Council shall be empowered to fix the powers and duties of office bearers of the workers union within the frame work of the constitution. The Central Council may delegates its power to any other committee nominated for the purpose.
26. Amendments To The Constitution
The constitution of worker’s union may be ammended by at least 2/3 delegates present in the meeting of General House of Delegates Conference. The notice of such amendments may be included in the agenda.
27. Dissolution of Union
The worker’s union may be dissolved at session of General House of Delegates Conference and may be attended by at least 2/3 delegates of the House. At least ¾th delegates should vote for dissolution. The House shall be competent to divide assets and liabilities of the Union in the manner they desire.
28. Savings
a) The Central Council of the union may permit to admit any Union/Organisation /Association comprising of Board’s employees, if such Union so expresses its desire in writing. Such members of so merged Union/Association/Organisation shall be equally competent to vote and contest election for office bearership.
b) In case of emergency election of Central Council can be deferred for one year. This can be done by the majority votes of Central Council, Circle Secretaries and Presidents of Unit Committees in a joint meeting. The joint meeting shall be convened by the General Secretary of the Union with one Month’s notice in advance.

30 . Union will be bound by code of discipline.
